Dispute Resolution


Individuals and businesses often turn to the courts to resolve disputes that arise with vendors, customers, employees, and competitors.  One of the first tasks is to determine whether it would be better to litigate the dispute or seek other another method of dispute resolution (ADR) and if the decision is to litigate, whether a bench trial or jury trial would be more appropriate.  After identifying some the factors that enter into these decisions, this module explores the civil litigation process from filing the complaint that initiates a civil lawsuit through discovery, trial and appeal.  To reduce the cost of litigation, many businesses prefer to resolve disputes through a method of alternative dispute resolution -- negotiation, mediation, arbitration, or a hybrid form of ADR.
